The EB-5 visa is a direct pathway to a Green Card for qualifying investors.

  • Job Creation: Must create or preserve at least 10 full-time jobs for U.S. workers 
  • Investment Vehicle: Can invest directly in your own business or through a USCIS-approved Regional Center

  • Direct path to lawful permanent residence (Green Card) 
  • Green Cards available for spouse and unmarried children under 21
  • No sponsor or employer required 

The E-2 Treaty Investor Visa 

The E-2 visa allows citizens of certain treaty countries to live and work in the U.S. based on a substantial investment in a U.S. business. 

Key Requirements: 

  • Nationality: Must be a citizen of a qualifying treaty country 
  • Investment: Substantial investment in a real operating enterprise 
  • Business Control: Must direct and develop the enterprise

  • Fast processing times
  • Renewable indefinitely as long as the business remains viable
  • Dependents (spouse and children) can join you; spouse can work

Important: E-2 is a non-immigrant visa and does not automatically lead to a Green Card. 

Key Differences Between EB-5 and E-2 

  • Type: EB-5 – Immigrant Visa (Green Card) | E-2 – Non-Immigrant Visa
  • Investment Amount: EB-5 – $800,000+ | E-2 – Substantial (often $100,000+)
  • Job Creation: EB-5 – Required (10 U.S. jobs) | E-2 – Business must not be marginal 
  • Nationality Requirement: EB-5 – None | E-2 – Must be from treaty country
  • Path to Green Card: EB-5 – Direct | E-2 – Indirect or separate process
