Introduction: Hope and Protection Through VAWA

The Violence Against Women Act (VAWA) offers hope and protection to immigrants who have been victims of abuse by U.S. citizens or lawful permanent residents. This blog post explains who qualifies, how the process works, and what steps you can take to secure your safety and future.

What is VAWA?

The Violence Against Women Act (VAWA) is a federal law that allows certain immigrant victims of domestic violence to apply for lawful status independently.

Key Features:

  • Self-petition without the abuser’s knowledge
  • Confidential application process
  • Pathway to a Green Card and eventually U.S. citizenship

Important: Despite its name, VAWA protects both women and men and includes protections for children and parents.

Who Qualifies for VAWA?

  • Spouse: Abused by a U.S. citizen or lawful permanent resident spouse
  • Child: Abused by a U.S. citizen or lawful permanent resident parent
  • Parent: Abused by a U.S. citizen son or daughter (over 21 years old)

You must also show:

  • Good faith relationship
  • Residence with the abuser at some point
  • Good moral character
  • Evidence of battery or extreme cruelty

How Do You Apply for VAWA?

1. Prepare Form I-360: Petition for Amerasian, Widow(er), or Special Immigrant

2. Gather Evidence:

  • Police reports, protection orders
  • Medical records
  • Affidavits from witnesses
  • Photographs
  • Personal declaration describing the abuse

3. File Your Petition Confidentially

4. Apply for Adjustment of Status: File Form I-485 if eligible

Tip: Emotional abuse, financial control, threats, and psychological cruelty can also qualify—not just physical violence.
