Request for Evidence (RFE): What It Means and What to Do

Attorney Edwin K. Fogam

Receiving a Request for Evidence (RFE) from USCIS can be concerning, but it is often a routine part of the immigration process. An RFE does not mean your case has been denied — it means USCIS needs additional information before it can make a decision.

RFEs may be issued when:

Required documents are missing — the initial petition or application did not include all necessary supporting materials

Evidence is insufficient — the documentation submitted does not adequately meet the legal standard for the benefit being requested

USCIS needs clarification about eligibility — the officer reviewing the case has questions about whether the applicant qualifies based on the facts presented
