Did the Supreme Court Just Put Birthright Citizenship at Risk?

A decision entered by the U.S. Supreme Court on June 27, 2025, has enabled the Trump Administration to continue challenging birthright citizenship. However, the court did not reach the constitutionality issue.

The Court ruled that lower courts cannot issue nationwide injunctions against executive orders. This decision was entered in the case of Trump vs. CASA. The Court did not address the issue of whether the Order was constitutional.

Based on this decision, the Trump administration may seek to enforce its Executive Order banning birthright citizenship in many states.

According to the 14th Amendment of the U.S. Constitution, any child born in the U.S. is a citizen. The Trump administration is attempting to curtail this right through an Executive Order. Whether this can work is a monumental question. This constitutional question will probably come before the U.S. Supreme Court sooner or later.
